No Exchanges – Notice to Ticket Holders

1.1) This ticket is a revocable license to attend Phoenix ConGames (referred further as “Event”). The ticket holder (referred further as “Holder”), on behalf of the Holder, agrees to all of the terms hereof. By purchasing this ticket on our website or third part authorized distributors, the Holder also agrees to be bound by the Terms and Conditions of Sale associated with this ticket hereof.

Conditions of Sale

2.1) The Holder agrees not to transmit, distribute or sell (or aid in the transmitting, distributing or selling) any description, account, picture, video, audio or other form of reproduction of the Event and any surrounding activities (in whole or in part) for which this ticket is issued. This ticket may not be used for any form of commercial or trade purposes, including but not limited to, advertising, promotions, contests or sweepstakes without the expressed written consent of ConEvents LLC.

2.2) The Holder grants permission to ConEvents LLC (and its licensees and agents) to use, reproduce, modify, display, and publish, without further authorization or compensation, the Holder’s image, likeness, actions and statements captured at the Event in any media now existing or developed hereafter.

2.3) Many events or attractions run at the Convention are run by independent contractors, groups, clubs and companies outside of the control of ConEvents LLC. ConEvents LLC is not always informed of the identity or nature of any such event or attractions. Individual events or attractions may be added, changed or cancelled at any time without notice and the Holder of this Ticket will not be entitled to any refund or other reimbursement in connection with any such addition, change or cancellation.

2.4) THE HOLDER OF THIS TICKET VOLUNTARILY ASSUMES ALL RISK AND DANGER OF PERSONAL INJURY (INCLUDING DEATH) AND ALL HAZARDS ARISING FROM, OR RELATED IN ANY WAY TO, THE EVENT, WHETHER OCCURRING PRIOR TO, DURING OR AFTER THE EVENT HOWSOEVER CAUSED AND WHETHER BY NEGLIGENCE OR OTHERWISE. THE HOLDER AGREES THAT CONEVENTS LLC (AND ITS AGENTS, OFFICERS, DIRECTORS, OWNERS AND EMPLOYEES) IS NOT LIABLE FOR ANY INJURIES RESULTING FROM SUCH CAUSES.

2.5) WARNING: SPECIFIC EVENTS PLACED IN “THE ARENA” CONTAIN A HIGH LEVEL OF PHYSICAL ACTIVITY; OBJECTS FLYING INTO SPECTATOR AREAS CAN CAUSE SERIOUS INJURY. BE ALERT AT ALL TIMES WHEN IN SPECTATOR AREAS. NOTIFY AN EVENT TEAM MEMBER FOR ASSISTANCE.

2.6) All sales are final. The Holder should treat this ticket as a regular ticket and keep it in a safe place at all times. ConEvents LLC is not responsible for any loss or inconvenience caused by any unauthorized duplication of this ticket. In the event duplicate copies of this ticket are presented, ConEvents LLC reserves the right to refuse entry to the Event for all ticket holders. This ticket cannot be replaced if lost, stolen or destroyed. Lost, stolen, counterfeit or otherwise unlawfully duplicated tickets, or those offered for resale at an unlawful premium, may not be honored. THE EVENT MAY BE SUBJECT TO CANCELLATION AND THE DATE AND TIME OF THE EVENT ARE SUBJECT TO CHANGE. If the Event is rescheduled, this ticket may only be exchanged pursuant to procedures established by ConEvents LLC.

2.7) Breach of any of the terms of this license, or the refunding to the Holder of the printed purchase price of this ticket, shall automatically terminate any rights that the Holder may have hereunder, shall render illegal and unauthorized the Holder’s use of the ticket for any purpose, and shall authorize ConEvents LLC to withdraw the ticket, refuse admission to the Event or eject the Holder from the Event. ConEvents LLC may refuse admission to, or eject, any Holder, without refund, who is deemed to be disorderly or who fails to comply with the terms of this license or any and all security measures. Breach of any of the terms of this license shall also subject the Holder to all legal remedies available to ConEvents LLC.

Notice to Ticket Holder in Addition to the Above.

3.1) Resale or attempted resale at a price higher than that printed herein is grounds for seizure or cancellation without refund or other compensation. Pursuant to ARS §13-3718(A)(B) the resale of tickets is in violation of state law and may result in fine, imprisonment or both.

3.2) Except as otherwise specifically provided by ConEvents LLC, it is unlawful to copy or otherwise reproduce this ticket. Pursuant to ARS §13-2001, §13-2002 and §13-2011(A) copy or reproduction of this ticket is in violation of state law and is a class (4) felony.

3.3) If Holder fails at any of the foregoing by the Holder may at the option of ConEvents LLC, result in the termination of any rights the Holder may have hereunder; shall render illegal and unauthorized the Holder’s use of ticket for any purpose; and shall subject the Holder to all legal remedies available to ConEvents LLC.
